Please join the Center for Constitutional Rights to hear oral arguments on a motion to dismiss in Turkmen v. Ashcroft, a CCR lawsuit filed in 2002 on behalf of a class of Muslim, South Asian, and Arab non-citizens swept up by the INS and FBI in connection with the 9/11 investigation, detained as “terrorism suspects” and held in brutal detention conditions for the many months it took the FBI and CIA to clear them of any connection to terrorism.

CCR Senior Staff Attorney Rachel Meeropol will argue that plaintiffs should be able to sue for damages over violence and other abusive treatment that they faced while held in federal prisons, and that the case should proceed. The hearing will be before Magistrate Judge Steven M. Gold in Courtroom 13-D.

Turkmen v. Ashcroft was previously before the Supreme Court (captioned as Ziglar v. Abbasi) and in a June 2017 ruling, the Court held that high-level federal officials could not be individually sued for their policy of profiling and ultra-restrictive conditions of confinement during the post-9/11 detentions. The Court sent claims against the warden, who allowed physical and other abuse not required by the high-level officials’ policy, back to the district court to determine whether the case against him may proceed.
