Hundreds of Haitians across the country were imprisoned by the U.S. Immigration and Customs Enforcement (ICE) agency following the January 12, 2010 earthquake, even though the Department of Homeland Security halted all deportations to Haiti as a result of the devastating event. The detention of non-citizens who had already completed removal proceedings raised serious constitutional concerns when their removal was not reasonably foreseeable under the 2001 Supreme Court decision, Zadvydas v. Davis. Unfortunately, in order to seek their release, each detainee had to formally request that ICE review their custody and grant release under reasonable conditions of supervision.
