As a lawyer who has represented Guantánamo detainees since the inception of the prison 20 years ago, I sometimes get asked, “What about these cases could you possibly still be litigating in 2022?” As it turns out, the answer is: quite a lot, from arcane questions about the scope of the government’s (possibly diminishing) detention authority to in-the-weeds rules governing what evidence the courts can consider against detainees.
